General Conditions of Use of the Masteris.com Website

PREAMBLE

The purpose of these General Conditions of Use (hereinafter the “CGU”) is to determine the conditions of access and rules of use in which the Site offers access to several online services accessible by the following link: masteris.com.
Access to the Site is subject to compliance with these T&Cs. Access to the Site is strictly reserved for the User as defined in these Terms and Conditions.
The Publisher reserves the right to modify or update these T&Cs at any time, unilaterally, as changes or additions are made, in particular in order to comply with any legal, jurisprudential, editorial and/or technical developments as well as any changes in the general conditions of use of the Host's services.
The User must regularly consult the latest version of the CGU, which is permanently available on the Site.

ARTICLE 1 — DEFINITIONS

Within these Terms of Use, words or expressions beginning with a capital letter will have the following meaning:

Any use of the Site will be in compliance with these Terms and Conditions.

ARTICLE 3 — ACCESS AND USE OF THE SITE

3.1 Accessibility to the Site

Access to the Site is possible from a computer, tablet or smartphone connected to a telecommunications network according to the communication protocols used on the Internet.
The Publisher grants the User the right to consult, use and access the Information on the Site.

3.2 Access cost

Access to the Site is free and does not require a subscription. All software and hardware necessary for the use or operation of the Site, access to the Internet or communication costs are the sole responsibility of the User outside of his workplace.
Each User is fully responsible for their login data concerning them. Unless proven otherwise, any connection to the Site, or transmission of data made using the User's login information, will be deemed to have been made by the User.

3.3 Accessibility time

The User's access to the Site is carried out for an unlimited period of time, without prejudice to the option for the User or the Publisher to terminate unilaterally, at any time, without notice or reason or compensation.

ARTICLE 6 — INTELLECTUAL PROPERTY

In general, the User is prohibited from infringing the intellectual property rights (copyright, related rights, sui generis right of the database producer, trademark law, domain names, etc.) of the Publisher and/or the Host, and/or of any third party.
The Publisher holds all intellectual property rights both in the structure and in the content of the Site (texts, logos, images, images, sound elements, software, icons, layout, database, etc.) or has regularly acquired the rights allowing the exploitation of the structure and content of the Site, without any limitation.

ARTICLE 8 — PERSONAL DATA

The user is informed that the personal data processed as part of the Site, from the contact forms, are subject to computerized processing under the responsibility of the Marketing & Communication Manager who can be reached at the email address service.marketing@masteris.com. The purpose of processing this data relating to civil status, identity, professional life and identification data is to allow Users to receive information relating to the activity of MASTERIS and will be communicated to the Masteris department concerned. This data is collected following the consent of the Users. Masteris will keep the data for the period necessary to pursue the purposes of the treatment and/or to comply with legal and regulatory obligations. This information will not be used for commercial purposes and will only be communicated to the competent authorities who request it. In any event, this data is kept strictly confidential. ARTICLE 10 — TRAFFIC STATISTICS

The User guarantees the Publisher, as well as its parent, sister or affiliated companies, its representatives, its employees, its partners and the Host, against any request, claim, claim and/or recourse of any kind, resulting from any violation of these provisions.
The User will indemnify them, at any time and at first request, against any damage and/or against any request, action, complaint from third parties resulting from any violation of these provisions.

Each User of the Site expressly undertakes:

ARTICLE 13 — NULLITY OF A CLAUSE

ARTICLE 14 — APPLICABLE LAW — SETTLEMENT OF DISPUTES

These CGU are subject to French law.
In the event of disputes relating to the interpretation, validity or execution of these T&Cs, the User and the Publisher agree to make their best efforts to resolve the dispute amicably.
In the event that an amicable agreement is not reached, any dispute relating to the interpretation or execution of these T&Cs will be subject to the jurisdiction of the courts of Paris.
